Please read these Terms of Service ("Terms") carefully before using https://promptlyagent.ai (the "Service") operated by Thorsten Ott ("us", "we", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. About the Service

PromptlyAgent is a free community platform that allows users to share and discover PromptlyAgent extensions, tools, and showcases. The Service is provided free of charge as a community resource.

2. Account Registration

To submit content to the Service, you must create an account using one of our OAuth providers (Google, GitHub, or Facebook).

When you create an account, you:

• Must be at least 16 years of age (GDPR requirement)
• Guarantee that the information you provide is accurate and current
• Are responsible for maintaining the security of your account
• Are responsible for all activities that occur under your account
• Must notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Community Submissions

3.1 Your Content

When you submit an extension, tool, or showcase ("Submission"), you represent and warrant that:

• You own or have the right to share the Submission
• The Submission does not violate any third-party rights (copyright, trademark, patent, trade secret, etc.)
• The Submission does not contain malicious code, viruses, or security vulnerabilities
• The Submission complies with all applicable laws
• Your GitHub repository URL is accurate and publicly accessible

3.2 License Grant

By submitting content to the Service, you grant us a non-exclusive, worldwide, royalty-free license to:

• Display your Submission on the Service
• Store and process your Submission metadata (title, description, screenshots, tags)
• Make your Submission discoverable to other users
• Create thumbnails and previews of your screenshots

You retain all ownership rights to your Submission. The code in your linked GitHub repository remains under its original license. We only display information about your Submission.

3.3 Submission Review

We review all Submissions before they appear publicly. We reserve the right to:

• Reject Submissions that violate these Terms
• Remove Submissions that are reported for violations
• Edit Submission metadata for clarity or compliance
• Delay approval during high-volume periods

4. Prohibited Content and Conduct

You may not submit or promote:

• Malicious software, viruses, or security exploits
• Content that infringes intellectual property rights
• Spam, deceptive, or misleading content
• Illegal content or content promoting illegal activities
• Harassment, hate speech, or discriminatory content
• Private or confidential information
• Content that violates export control laws

You may not:

• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Use automated tools to scrape or copy content
• Impersonate another person or entity
• Manipulate view counts or engagement metrics

5. GitHub Repository Requirements

Submissions must link to valid, publicly accessible GitHub repositories. We are not responsible for:

• The availability or functionality of linked repositories
• Changes made to repositories after submission approval
• Issues, bugs, or security vulnerabilities in the linked code
• Support or maintenance of the linked projects

If a repository becomes unavailable or violates GitHub's Terms of Service, we may remove the Submission.

6. Intellectual Property

The Service and its original content (excluding user Submissions), features, and functionality are owned by Thorsten Ott and are protected by international copyright, trademark, and other intellectual property laws.

The PromptlyAgent name and logo are trademarks. You may not use these without prior written permission.

7. Third-Party Services

The Service integrates with third-party services:

• OAuth Providers: Google, GitHub, Facebook - for authentication
• GitHub: For repository information and links
• Google Analytics: For usage statistics (with your consent)

We are not responsible for the availability, content, or practices of these third-party services. Your use of these services is subject to their own terms and privacy policies.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• That the Service will be uninterrupted, secure, or error-free
• That defects will be corrected
• That the Service is free of viruses or harmful components
• The accuracy, reliability, or quality of any content or information obtained through the Service

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THORSTEN OTT SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your access to or use of (or inability to access or use) the Service
• Unauthorized access to or alteration of your content
• Statements or conduct of any third party on the Service
• Any issues related to linked GitHub repositories or user Submissions

This limitation applies even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow limitations on implied warranties or liability for incidental or consequential damages, so the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Thorsten Ott from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your Submissions
• Your violation of these Terms
• Your violation of any third-party rights

11. DMCA and Copyright Infringement

We respect intellectual property rights. If you believe content on the Service infringes your copyright, please send a DMCA notice to:

Your notice must include:

• Description of the copyrighted work claimed to be infringed
• URL or location of the allegedly infringing material
• Your contact information (name, address, phone, email)

We will respond to valid DMCA notices and may remove or disable access to allegedly infringing content.

12. Termination

We may suspend or terminate your account and access to the Service:

• If you violate these Terms
• If we receive a valid legal request
• If we determine your use poses a security or legal risk
• At our sole discretion, with or without notice

Upon termination:

• Your access to the Service will cease
• Your Submissions may be removed (at our discretion)
• Provisions that should survive termination will remain in effect

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Germany.

If you are a consumer residing in the EU, you may also have rights under the laws of your country of residence.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last updated" date
• Sending an email notification (for significant changes)

Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

If you do not agree to the changes, you must stop using the Service and may request account deletion.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.

17. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
